Terms and Conditions of Sale
Introduction
This document outlines the standard Terms and Conditions pertaining to the sale of goods to our customers.
By accepting a quotation or conducting business which leads the issue of an invoice, you agree to accept all terms and conditions outlined here.
Orders
It is the customer's responsibility to ensure that goods ordered will meet the requirements of the intended use.
Orders for hardware need to be paid in full and payments cleared in our bank account before processing will take place. Until such time as the payment has been made, ownership of goods reside with the Company.
Prices, specifications and availability of products change from time to time. It is the customer's responsibility to confirm the correctness of the forementioned before placing the order. Should any of the forementioned be invalid, you agree to accept all risk associated with such products.
Should circumstances dictate so, the Company may change or cancell orders. In such events SafeSun Systems will attempt to inform you. In rare occasions where products may be unavailable the Company will use its discretion in the substitution of products which may affect the material content of the order.
Ownership
Safesun Systems (Pty) retains ownership of all goods until full payment of the supplied equipment is received. Payment for services are due upon delivery of an invoice for the same, or upfront in proportion to the agreed percentage as per prior arrangement in which case full payment is due upon delivery of an invoice for the same. Should payment for services not be paid in full, Safesun Systems (Pty) Ltd reserves the right to render the service ineffective until such time that payment is received.
Delivery and Collection
In general Goods are available for collection within 5 business day. Collection need to be arranged with your customer representatives.
Delivery of goods will take place during business hours. It is your responsibility to ensure that someone is available to receive products at the delivery address.
Returns
A 10% levy on all product returns will be charged.
Unwanted Goods
Undamaged goods may be returned within 7 day based on the the following:
Goods are unused and in its original condition within the same packaging as delivered.
- Where appropriate, all accessories which was ordered together and is required for the correct operation of a product, packaged separately and delivered in the same order, will be returned together with the returned product.
- The original invoice need to accompany the returned goods.
Faulty Goods
Faulty goods must be returned to the nearest store within 7 days from the date of purchase based on the following:
- Goods are unused and in its original packaging as delivered.
- Where appropriate, all accessories which was ordered together and is required for the correct operation of a product, packages separately and delivered in the same order, will be returned together with the faulty product.
- The original invoice to accompany the returned goods.
Refunds
Refunds will attract a 10% handling fee. At the sole discretion Safesun Systems may process a full refund where products deem to be unusable due to no fault of itself or the customer.
Refunds will take up to 4 business days to process after adjudication of the return.
Limitation of liability
In no event shall SafeSun Systems(Pty) Ltd, nor any of its officers, directors or employees be held liable for anything arising out of or connected to the use of the products in any way other than the intended use including but not limited to any direct, consequential or special liability.
Indemnification
The customer hereby indemnify SafeSun Systems(Pty) Ltd, its officers, employees and agents, against any liability, cost, demands, cause of action, damage or expenses arising from the breach of any of the terms and conditions set-out herein.
Severability
If any of the provisions in these Terms and Conditions are found to be invalid under the applicable law of the Republic of South Africa, such law shall prevail and the determination be subordinate to the regulation governing the determination.
Right of change
Safesun Systems (Pty) Ltd has the right to change these Terms and Conditions from time to time as required and as it seems fit.
Right of Secession
Safesun Systems (Pty) Ltd has the right to assign, transfer, or subcontract it rights and/or obligations relating to the services to any third party without notification.
Entire Agreement
These terms constitute the entire agreement between Safesun Systems and the Customer for the transfer of ownership and services rendered to the Customer.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and interpreted according to the laws of the Republic of South Africa and the Customer submit to the non-exclusive jurisdiction of the Republic of South Africa for the resolution of any disputes.
